CV Investigation Aligned with AD Investigation, Causing CV Cash Deposit/Bond Requirement to be Lifted in Four Months

The ITA and ITA sources state that at the request of petitioners, the ITA is aligning the final determination in this CV duty investigation with the final determination in the companion antidumping (AD) duty investigation, which is currently due no later than September 1, 2004.

Pursuant to 19 USC 1671b(d), suspension of liquidation and CV cash deposit/bond requirements pursuant to a preliminary CV duty determination may only remain in effect for four months. (In this case, four months from April 27, 2004, or approximately August 26, 2004.)

Consequently, the CV cash deposit/bond requirements for subject merchandise are expected to be lifted at the end of this four month period (and only reinstated if and when a CV duty order is issued).

Liquidation however, is expected to remain suspended beyond the four month period if the ITA issues a preliminary affirmative determination in the companion AD duty investigation before the four month period ends.
