The Offset Act (also known as the Byrd Amendment) provides that the assessed duties received pursuant to an antidumping (AD) duty order or a countervailing (CV) duty order will be distributed by CBP to affected domestic producers as an offset for certain qualifying expenditures.

The Offset Act only covers AD and CV duty assessments made on or after October 1, 2000 in connection with AD and CV duty orders in effect as of January 1, 1999 or issued thereafter.

Preliminary Amounts May be Used to Determine Whether to File a Certification

CBP has previously stated that affected domestic producers may view the preliminary dollar amounts in order to determine whether it would be worthwhile to file a certification in a given case. However, CBP has noted that the final amounts available for disbursement may differ from the preliminary amounts.

(See ITT's Online Archives or 06/04/04 news, 04060420, for BP summary of CBP's intent to distribute FY 2004 AD/CV revenues, and instructions for filing a certification by August 2, 2004.)
