AD: China Bulk Aspirin

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of bulk aspirin from China for the period of July 1, 2002 through June 30, 2003. In addition, the ITA is revoking the AD duty order with respect to one company.

Antidumping Duty Order Revoked for One Company

Revocation of AD Duty Order for Shandong

The ITA states that it is revoking the AD duty on bulk aspirin from China with respect to Shandong Xinhua Pharmaceutical Co., Ltd. (Shandong) because, among other reasons, it found that (1) Shandong had zero or de minimis AD duty rates for a period of at least three consecutive years; (2) Shandong has agreed to immediate reinstatement of the order if the ITA finds that it has resumed making sales at less than normal value, and (3) the continued application of the order is not otherwise necessary to offset dumping. Therefore, the ITA states that for the final results, it finds that Shandong qualifies for revocation of the AD duty order on bulk aspirin from China, pursuant to 19 CFR 351.222(b)(2).

The ITA explains that this revocation applies to all entries of subject merchandise that are produced and exported by Shandong.

The ITA states that it will terminate the suspension of liquidation for bulk aspirin produced and exported by Shandong that has a time of entry on/after July 1, 2003, and will instruct U.S. Customs and Border Protection (CBP) to refund with interest any cash deposits for such entries.

Assessment Instructions for the Review Period (07/01/02 - 06/30/03)

According to the ITA, it will determine, and CBP will assess, AD duties on all appropriate entries. The ITA states that it will issue appropriate assessment instructions directly to CBP within 15 days of June 22, 2004.

The ITA also states that all other entries of subject merchandise during the period of review will be liquidated at the AD duty rate in place at the time of entry.
