USTR Requests Comments on WTO Dispute Concerning the ITC's Final Injury Determination on Red Hard Spring Wheat from Canada

The Office of the U.S. Trade Representative (USTR) has issued a notice stating that Canada has requested the establishment of a World Trade Organization (WTO) dispute settlement panel (DSP) to examine the International Trade Commission's (ITC's) final determination of material injury with respect to red hard spring wheat from Canada.

The USTR is requesting written comments from the public by September 15, 2004 on this WTO dispute.

Canada Alleges ITC's Injury Determination Violates Certain WTO Agreements

The USTR states that in its request, Canada alleges that the U.S. has violated an article of the General Agreement on Tariffs and Trade 1994 (GATT 1994), and certain articles of the Agreement on Implementation of Article VI of GATT 1994 (Anti-Dumping Agreement) and of the Agreement on Subsidies and Countervailing Measures (SCM Agreement).

According to the USTR, Canada alleges that these violations stem from certain errors in the ITC's final injury determination regarding red hard spring wheat from Canada. (See USTR's notice for listing of Canada's specific claims.)
