CV: Brazil Hot-Rolled Flat-Rolled Carbon-Quality Steel

The International Trade Administration (ITA) has issued a notice announcing that effective September 26, 2004, it is terminating its countervailing (CV) suspension agreement and issuing a CV duty order on hot-rolled flat-rolled carbon-quality steel from Brazil.

Countervailing Duty Order to Take Effect September 26, 2004

As a result, the ITA is expected to instruct Customs and Border Protection (CBP) to suspend liquidation (for CV duty purposes) on entries of subject merchandise with a time of entry on or after September 26, 2004, and to require CV cash deposits at the following rates (which were established in its 1999 final affirmative CV duty determination in this proceeding):

1 Although the ITA's notice lists USIMINAS and COSIPA as separate companies, ITA sources state that these two companies continue to be collapsed into one for purposes of this CV duty investigation. Sources state that the ITA is likely to issue a correction to indicate these companies are collapsed, as indicated above.

The ITA states that the "all others" rate applies to all producers and exporters of subject merchandise not specifically listed above.

(According to the ITA, the export limits of the CV suspension agreement were set to expire on September 30, 2004 unless extended. In addition, the ITA had previously stated that certain export license requirements were also in effect for the export limits in the CV suspension agreement.)
