ITC Issues Proposed Rule to Amend its AD & CV Rules of Practice and Procedure

The International Trade Commission (ITC) has issued a proposed rule that would amend certain provisions of 19 CFR Parts 206 and 207 with respect to its Rules of Practice and Procedure.

This proposed rule stems from a December 2002 notice in which the ITC invited the public to provide input on specific ways in which it could improve its conduct of antidumping (AD) and countervailing (CV) duty investigations. (See ITT's Online Archives or 12/06/02 news, 02120615, for BP summary.)

Examples of ITC's Proposed Changes

The following are examples of the changes that the ITC has proposed (partial list):

Petitions filed after 12 noon would be considered filed the next business day. The ITC is proposing to amend 19 CFR 207.10(a) to provide that if the proper number of copies of a petition is not filed until after 12 noon, the filing date would be deemed to be the next business day.

Prehearing briefs would be due five business days prior to the hearing. The ITC is proposing to amend 19 CFR 207.23 to require that prehearing briefs would be due five business days (rather than four business days) prior to the hearing.

Clerical and staff APO applications would no longer be filed with ITC. With respect to 19 CFR 207.7(b), the ITC proposes that the Administrative Protective Orders (APOs) that are required to be signed by persons such as paralegals and clerical staff who are employed or supervised by an authorized applicant should no longer be submitted to the ITC. Rather, the authorized applicant would be responsible for the forms' retention and accuracy.
