2The ITA indicates that these AD duty rates reflect an adjustment for export subsidies

found in the CV duty investigation.

3The ITA states that it received a timely ministerial-error allegation from Pidilite. As a

result, the final AD duty rate has been amended for Pidilite and for All others.

Critical Circumstances, Suspension of/Reinstating Liquidation, Assessment

China (AD). The ITA states the ITC has made a final determination that critical circumstances do not exist with respect to imports of subject merchandise from all producers and exporters, and will instruct U.S. Customs and Border Protection (CBP) to lift suspension of liquidation and release any bond or cash deposit made to secure AD duties on subject merchandise with a time of entry prior to June 24, 2004.

The ITA states it will direct CBP to assess, upon further advice by the ITA, AD duties on all unliquidated entries of subject merchandise from China with a time of entry on or after June 24, 2004 through December 20, 2004, and on and after December 28, 2004.

(The ITA states that it terminated the suspension of liquidation for entries of subject merchandise with a time of entry of December 21 through December 27, 2004, in accordance with 19 USC 1673b(d). Entries of CVP-23 with a time of entry during this period are not liable for the assessment of AD duties. Suspension of liquidation will continue on or after December 28, 2004.)

India (AD). The ITA states it will direct CBP to assess, upon further advice by the ITA, AD duties on all unliquidated entries of subject merchandise from India with a time of entry on or after June 24, 2004 through December 20, 2004, and on and after December 28, 2004.

(The ITA states that it terminated the suspension of liquidation for entries of subject merchandise with a time of entry of December 21 through December 27, 2004, in accordance with 19 USC 1673b(d). India (CV). The ITA states that it will direct CBP to assess CV duties on all unliquidated entries of subject merchandise from India with a time of entry on or after April 27, 2004 through August 25, 2004, and on or after December 28, 2004.

(According to the ITA, entries of subject merchandise from India with a time of entry on or after August 26, 2004 through December 27, 2004 are not liable for the assessment of CV duties due to the ITA's discontinuation of the CV suspension of liquidation, pursuant to 19 USC 1671b(d).

The ITA adds that it will also direct CBP to reinstitute the CV suspension of liquidation for subject merchandise effective December 28, 2004.)
