CBP Modifies its 2005 TRQ Notice on Certain Worsted Wool Fabrics Under New 9902.51.15 and 9902.51.16
U.S. Customs and Border Protection (CBP) has posted to its web site a revised version of its 2005 Tariff Rate Quota (TRQ) notice for certain worsted wool fabrics under new tariff numbers HTS 9902.51.15 and 9902.51.16.

(CBP's revised TRQ notice, as well as its initial one, refers to these fabrics as being of worsted wool, while the Chapter 99 tariff numbers describe the tariff numbers as fabrics of combed wool, and the applicable Chapter 99 HTS chapter notes describe them as worsted wool fabrics. New Tariff Numbers Accidentally Cover Both the Wool Fabric and Fine Animal Hair of Cashmere
The Miscellaneous Trade and Technical Corrections Act of 2004 (P.L. 108-429) accidentally gave subject wool fabric that is subject to a TRQ, and fine animal hair of Kashmir (cashmere) goats which is not subject to a TRQ, the same new Chapter 99 8-digit tariff numbers, 9902.51.15 and 9902.51.16.
(HTS 9902.51.15 covers both subject wool fabric and cashmere hair, as does HTS 9902.51.16.)
This error was initially was "corrected" by adding 9th and 10th digits to distinguish the wool fabric from the fine animal hair of cashmere; however, ACS quota (TRQ) programming cannot accept 10-digit HTS Chapter 99 numbers.
Last Two Digits Removed for Subject Combed Wool Fabric
As a result, the last two digits (the 9th and 10th digit) of 9902.51.15 and 9902.51.16 have been removed for the TRQ on the wool fabric.
(The numbers previously were 9902.51.1550 and 990251.1650.)
Last Two Digits Remain for Fine Animal Hair of Cashmere
However, CBP sources state that as fine animal hair of cashmere is not subject to a TRQ, the last two digits of their two tariff numbers remain.
As a result, the numbers continue to be 9902.51.1510 and 9902.51.1610.
