AD: China Certain Crepe Paper

The International Trade Administration (ITA) has published in the January 25, 2005 Federal Register its antidumping (AD) duty order on certain crepe paper products from China. The ITA also states that the International Trade Commission (ITC) has made a final negative critical circumstances determination (thereby reversing the ITA's preliminary affirmative critical circumstances determination).

AD liability. As a result, the ITA indicates that entries of subject merchandise from China will be liable for the possible assessment of AD duties for all unliquidated entries with a time of entry on or after September 21, 2005, the date of the ITA's preliminary affirmative AD duty determination.

Suspension of liquidation lifted for critical circumstances time period. As the ITC has made a final determination that critical circumstances do not exist with respect to imports of subject merchandise, the ITA states it will instruct U.S. Customs and Border Protection (CBP) to lift suspension of liquidation and release any bond, and refund any cash deposit, made to secure AD duties on subject merchandise with a time of entry on or after June 23, 2004, but before September 21, 2004.

Cash deposit only. According to ITA sources, effective for entries with a time of entry on or after January 24, 2005 (the date that the ITC's final AD injury determination and final negative critical circumstances determination were published in the Federal Register), CBP must require, at the same time as importers would normally deposit estimated duties on the subject merchandise, an AD cash deposit at the rates (weighted average margins) listed below:

The ITA states that Fuzhou Light Industry Import and Export Co., Ltd. and Fuzhou Magicpro Gifts Co., Ltd. were inadvertently listed separately in the final determination. According to the ITA, in line with the preliminary determination, these two companies are part of the China-wide entity.

As stated in the final determination, Fujian Xinjifu Enterprises Co., Ltd. is now considered to be part of the China-wide entity and not a Section A respondent.
