ITC Seeks Comments on Tsunami's Impact on Shrimp Industries in India and Thailand

The International Trade Commission (ITC) has issued a notice requesting comments by March 25, 2005 on whether there are changed circumstances brought about by the recent tsunami sufficient to warrant the institution of investigations to review the ITC's affirmative injury determinations in its antidumping (AD) investigations on certain frozen warmwater shrimp from India and Thailand.

ITC to Decide Whether to Initiate Changed Circumstances Reviews

The ITC states that at the time the record for these investigations closed, factual information as to any impact of the December 26, 2004 tsunami on the ability of producers in India or Thailand to produce and export shrimp was not available. At its January 6, 2005 vote and in its views in these investigations, the ITC stated its intention to collect information as to whether the tsunami's impact on the affected countries' industries warrants the ITC self-initiating a changed circumstances review under 19 USC 1675(b).

Comments Should Address Impact of Tsunami on Ability of India & Thailand to Produce and Export Shrimp

The ITC states that information submitted should address the impact of the tsunami on the ability of the shrimp industries in India and Thailand to produce and export shrimp to the U.S. (See ITC notice for examples of such information.)

Subscribers should note that if a changed circumstances review results in a negative injury determination, it is expected that the AD duty order would be revoked.
