NAFTA Countries: CITA Seeks Comments on Request for "Short Supply" Determination on Certain Woven Fabrics Used to Make Boxer Shorts
The Committee for the Implementation of Textile Agreements (CITA) is requesting written comments by April 29, 2005 regarding a "short supply" request it received under the NAFTA from the Robinson Manufacturing Company (Robinson):

alleging that certain cotton and cotton-polyester blend woven fabrics of certain specifications used in the manufacture of boxer shorts cannot be supplied by the NAFTA region in commercial quantities in a timely manner and;
requesting that CITA consider whether the NAFTA rules of origin regarding boxer shorts classified under HTS 6207.11 should be modified to allow the use of certain non-North American woven fabrics.
CITA states that Robinson describes the woven fabrics as plain woven with a fiber content of 100% cotton, or a blend of 51 to 60% cotton and 49 to 40% polyester, and classifiable under HTS 5210.11.60, 5210.51.60, 5210.41.80, 5210.41.60, 5210.51.60, 5210.51.40, 5208.42.40, 5208.41.40, 5208.52.30 and 5208.51.40.See CITA's notice for full specifications of the subject fabric's weight, finish, and yarn number.
CITA Seeks Comments on Availability of Fabrics, Etc.
CITA states that it is soliciting public comments regarding this request, particularly with respect to whether the woven fabrics described above can be supplied by the domestic industry in commercial quantities in a timely manner.
CITA also states that if a comment alleges that these woven fabrics can be supplied by the domestic industry in commercial quantities in a timely manner, CITA will closely review any supporting documentation, such as a signed statement by a manufacturer of woven fabrics stating that it produces one or more of the woven fabrics that are the subject of the request, including the quantities that can be supplied and the time necessary to fill an order, as well as any relevant information regarding past production.
CITA Recommendation, Agreement with NAFTA Governments, Etc. Required for President to Proclaim Modification
NAFTA provides that if CITA recommends the modification to the NAFTA rules of origin requested by Robinson, and all the NAFTA governments1 agree to accept such a modification, the President may proclaim the modification no sooner than 60 calendar days after:
- he has obtained advice from the appropriate advisory committees and the International Trade Commission (ITC);
- he has submitted a report to the House Ways and Means and Senate Finance Committees regarding the modification, and;
- he has consulted with those Committees on the modification.
