AD: Canada Certain Softwood Lumber Products

The International Trade Administration (ITA) has initiated an antidumping (AD) duty changed circumstances review of the AD duty order on certain softwood lumber products from Canada at the request of the Coalition for Fair Lumber Imports (Coalition), a domestic interested party.

Initiation of AD Duty Changed Circumstances Review

West Fraser and Weldwood to be Reviewed

According to the ITA, the Coalition contends that two companies participating as separate companies in the ongoing second AD duty administrative review of subject merchandise from Canada, West Fraser Mills Ltd. (West Fraser) and Weldwood of Canada Limited (Weldwood), should have a combined AD cash-deposit rate because they are no longer separate companies.

The ITA adds that the Coalition has provided information indicating that as of January 1, 2005, Weldwood was amalgamated with West Fraser and ceased to exist as a separate corporate entity. As a result, the Coalition is requesting that the ITA initiate a changed circumstances review to establish a new AD cash-deposit rate for the merged entity.

The ITA is initiating this changed circumstances review in order to determine the facts surrounding the merger and what AD cash-deposit rate should be applied to entries produced and exported by the merged entity.

The ITA states that the preliminary results of this AD duty changed circumstances review will be published in the Federal Register and the ITA will issue the final results not later than 270 days after June 13, 2005 or within 45 days of June 13, 2005 if all parties to the proceedings agree to the outcome of the review.
