The ITA states that in these final results, it now finds that Shanxi Fengkun Foundry Ltd., Co. (Fengkun Foundry) is the successor-in-interest to Shanxi Fengkun Metallurgical Ltd., Co. (Fengkun Metallurgical).
In the preliminary results, the ITA had found that Fengkun Foundry was not successor-in-interest to Fengkun Metallurgical. However, after consideration of new factual information solicited by the ITA and comments from interested parties, the ITA now finds that Fengkun Foundry is the successor-in-interest to Fengkun Metallurgical, and that Fengkun Foundry should retain the deposit rate assigned to Fengkun Metallurgical by the ITA for all entries of subject merchandise produced or exported by Fengkun Metallurgical.
According to U.S. Customs and Border Protection's (CBP's) AD/Countervailing (CV) query, the current AD duty cash deposit rate for Fengkun Metallurgical is zero.
The ITA states that, as of July 18, 2005, it will instruct CBP to assign Fengkun Foundry the zero AD duty rate applicable to Fengkun Metallurgical. The ITA states that the cash-deposit requirement will be effective for all shipments of subject merchandise with a time of entry on or after July 18, 2005.
