ITA Publishes Lists of Completed, Terminated, and Pending AD & CV Duty Scope Rulings and Anticircumvention Inquiries

The International Trade Administration (ITA) has published its lists of completed and terminated antidumping (AD) and countervailing (CV) duty scope rulings; pending scope and anticircumvention inquiries; and a scope ruling inadvertently omitted from prior published lists.

The ITA's lists include the country, case number, product, requester(s), and a brief description of the ruling or inquiry. The ITA notes that subsequent lists will follow after the close of each calendar quarter.

According to the ITA, interested parties are invited to comment on the completeness of the list of pending scope and anticircumvention inquiries.

List of Completed, Terminated, & Pending Rulings and Inquiries, Etc.

Listed below are the country, product, case number, and status for each of the AD/CV cases in the ITA's notice (note the "status legend" at the end of the list).

Several of the AD/CV cases listed below have more than one completed, terminated, and/or pending ruling and/or inquiry. In addition, the numerical notes below "highlight" some of the rulings and inquiries.

Scope ruling inadvertently omitted from prior published lists

1 Completed scope ruling that certain components of a "Garden Cart" if imported separately are within the scope of the order.

2 Among others, the following scope rulings have been completed for this order: an "orchid stem" candle is excluded because it is an identifiable object and a "Garden Ridge" candle is excluded because it is associated with a recognized holiday.

The pending anticircumvention inquiries for this order are (1) whether imports of palm and vegetable-based wax candles can be considered later-developed merchandise which is now circumventing the order, and (2) whether imports of palm and vegetable-based wax candles can be considered a minor alteration to the subject merchandise for purposes of circumventing the order.

3 Completed scope ruling that certain stainless steel bar that is manufactured in the United Arab Emirates from stainless steel wire rod imported from multiple subject countries is excluded from the scope of the orders.

4 Completed scope ruling that certain electrolytic tin plate and tin free steel products, made in Colombia from Japanese single-reduced black plate and double-reduced black plate, are excluded from the scope of the order.

5 Pending scope inquiry on whether removable memory modules placed on motherboards that are imported for repair or refurbishment are within the scope of the order.

6 Pending anticircumvention inquiry on whether imports of frozen fish fillets from Cambodia made from live fish sourced from Vietnam, and falling within the scope of the order are circumventing the order.
