Antidumping & Countervailing Duty Order Administrative Reviews Initiated

1 ITA sources have stated by phone that for these cases, if one of the named companies subject to review does not qualify for a separate rate, all other exporters of subject merchandise from China who have not qualified for a separate rate are deemed to be covered by this review as part of the single China-wide entity of which the named exporters are a part. According to ITA sources, a footnote(s) to this effect was incorrectly omitted from the Federal Register notice.

ITA received requests to revoke AD and CV duty orders in part. The ITA states that it has received timely requests to revoke in part the CV duty order on Individually Quick Frozen Red Raspberries from Chile and the AD duty order on Certain Pasta from Italy.

The ITA states that during any administrative review covering all or part of a period falling between the first and second or third and fourth anniversary of the publication of an AD duty order under 19 CFR 351.211 or a determination under 19 CFR 351.218(f)(4) to continue an order or suspended investigation (after sunset review), the Secretary of Commerce, if requested by a domestic interested party within 30 days of the date of publication of the notice of initiation of the review (in this case, within 30 days of August 29, 2005), will determine whether AD duties have been absorbed by an exporter or producer subject to the review if the subject merchandise is sold in the U.S. through an importer that is affiliated with such exporter or producer.

The ITA notes that the request must include the name(s) of the exporter or producer for which the inquiry is requested.

The ITA intends to issue the final results of these reviews not later than July 31, 2006.
