Antidumping & Countervailing Duty Order Administrative Reviews Initiated

The ITA states that it revoked this AD order in part with respect to entries of subject merchandise produced and exported by Viraj Alloys, Ltd., and VSL Wires, Ltd., effective December 1, 2003. As a result, the ITA is conditionally initiating a review with respect to certain companies, pending further information from the requestor as to sales of subject merchandise not covered by the revocation.

If one of the companies associated with these administrative reviews does not qualify for a separate rate, the ITA states that all other exporters of the subject merchandise from China who have not qualified for a separate rate are deemed to be covered by these AD duty administrative reviews as part of the single China-wide entity of which the named exporters are a part.

Footnote number 2 applies. In addition, for those companies for which the ITA is conducting a new shipper review, this administrative review will only cover entries not covered by those new shipper reviews.

4The ITA states that because petitioners have requested an administrative review of this CV duty order and no individual exporters requested the review, it will be conducting the review of this order on an aggregate basis.

*According to the ITA, it collapsed certain companies in previous segments of this proceeding, so for this review it considers these parties to constitute a single entity.

Requests to revoke in part. According to the ITA, it has also received a timely request to revoke in part the AD duty order on Honey from Argentina with respect to two exporters.

Requests between certain anniversaries of publication. The ITA states that during any administrative review covering all or part of a period falling between the first and second or third and fourth anniversary of the publication of an AD duty order under 19 CFR 351.211 or a determination under 19 CFR 351.218(f)(4) to continue an order or suspended investigation (after sunset review), the Secretary of Commerce, if requested by a domestic interested party within 30 days of the date of publication of the notice of initiation of the review (in this case, within 30 days of February 1, 2006), will determine whether AD duties have been absorbed by an exporter or producer subject to the review if the subject merchandise is sold in the U.S. through an importer that is affiliated with such exporter or producer.

The ITA notes that the request must include the name(s) of the exporter or producer for which the inquiry is requested.

The ITA intends to issue the final results of these reviews not later than Dec. 31, 2006.
