ITA Publishes Lists of Recently Completed, Pending, Etc. AD and CV Duty Scope Rulings and Anticircumvention Inquiries

The International Trade Administration (ITA) has published its lists of recently completed antidumping (AD) and countervailing (CV) duty scope rulings; terminated scope inquiries; and pending scope and anticircumvention inquiries.

The ITA's lists include the country, case reference number, requestor(s), and a brief description of either the ruling or product subject to the request. The ITA notes that subsequent lists will follow after the close of each calendar quarter.

List of Pending and Recently Completed Rulings and Inquiries, Etc.

Listed below are the country, product, case number, and status for each of the AD and CV cases in the ITA's notice (note the "status legend" at the end of the list).

Several of the AD and CV cases listed below have more than one completed, terminated, and/or pending ruling and/or inquiry. In addition, the numerical notes below "highlight" some of the rulings and inquiries.

1Among other actions, three completed scope rulings resulted in the following conclusions: (1) infant (baby armoires and toy boxes and chests are within the scope of the AD duty order, (2) three-sided wooden day beds with the back being longer than the two sides and are designed for use with a metal daybed link spring support (also known as a "top spring") are within the scope of the AD duty order, and (3) a cell phone stash chair, wale stash chair, dolphin stash chair, and stash cube are excluded from the AD duty order.

2A scope pending inquiry concerning whether lumber entering under HTS 4409.10.05 is within the scope of the AD duty order.

3A scope pending inquiry concerning whether pure and alloy magnesium processed in Canada, France, or any third country and exported to the U.S. using pure magnesium ingots originally produced in China is within the scope of the AD duty order.

4IThe pending scope inquiry as to whether certain basa and tra fillets from Cambodia, which are a product of Vietnam, are excluded from the AD duty order. The pending anticircumvention inquiry concerns whether imports of frozen fish fillets from Cambodia made from live fish sourced from Vietnam, and falling within the scope of the order, can be considered "merchandise completed or assembled in other foreign countries" and are circumventing the AD duty order.
