Liquidation suspended, preliminary critical circumstances found for TK. The ITA states that because of a preliminary critical circumstances finding for TK, it is directing U.S. Customs and Border Protection (CBP) to suspend liquidation of all imports of subject merchandise from TK with a time of entry on or after 90 days prior to March 27, 2006.
As preliminary critical circumstances were not found for exports from other companies, the ITA is directing CBP to suspend liquidation of entries of subject merchandise from all other companies that have a time of entry on or after March 27, 2006.
Post bond or cash deposit on/after March 27, 2005. The ITA states that it is also instructing CBP to require a cash deposit or the posting of a bond equal to the AD rates (margins) indicated below, for entries of CLPP from Indonesia with a time of entry on or after March 27, 2006, as follows:
| Liquidation Suspended | Post Bond/Cash Deposit |
|---|---|
| Company | AD Rate |
| P.T. Pabrik Kertas Tjiwi Kimia T.B.K. (TK) | 118.63% |
| All Others | 97.85% |
ITA to Make Final AD Determination Within 75 Days of March 20, 2006
The ITA states that it will make its final determination within 75 days after the March 20, 2006 date of its preliminary affirmative AD duty determination. The ITA adds that the International Trade Commission (ITC) will make its final determination whether imports covered by the ITA's final determination are materially injuring, or threatening material injury to, the U.S. industry. According to the ITA, the deadline for the ITC's determination would be the later of 120 days after March 20, 2006 or 45 days after the date of the ITA's final AD duty determination.
(See ITA's notice for more information, including the scope of the investigation which, aside from minor changes of an editorial nature, appears to be substantially unchanged from the scope published in the initiation of this AD duty investigation, etc.
