Opportunity to Request Administrative Reviews of AD and/or CV Duty Orders

The International Trade Administration (ITA) has issued a notice announcing the opportunity to request administrative reviews by May 31, 2006 for individual producers or exporters subject to the following antidumping (AD) and/or countervailing (CV) duty orders:

The ITA notes that if the review request involves a non-market economy (NME) and the parties subject to the review request do not qualify for separate rates, all other exporters of subject merchandise from the NME country who do not have a separate rate will be covered by the review as part of the single entity of which the named firms are a part.

If it does not receive, by May 31, 2006, a request for an administrative review of entries covered by an AD or CV duty order listed above for the identified review period, it will instruct U.S. Customs and Border Protection (CBP) to assess AD or CV duties on those entries at a rate equal to the cash deposit of (or bond for) estimated AD or CV duties required on those entries at the time of entry, and to continue to collect the AD/CV cash deposit previously ordered.

ITA Clarifies Policy on Assessing AD Rates for Certain Resellers/Intermediaries

The ITA further notes that in May 2003 it clarified its practice with respect to the collection of final AD duties on imports of merchandise (from countries other than NME countries) where intermediate firms are involved. The ITA states that the public should be aware of this clarification in determining whether to request an administrative review of merchandise subject to AD orders.
