APHIS Issues Risk Assessment for Proposed Rule to Require Phytosanitary Certificate for Fruits and Vegetables Imported in Air Passenger Baggage

In August 2001, the Animal and Plant Health Inspection Service (APHIS) issued a proposed rule to require a phytosanitary certificate to accompany all commercial shipments of produce imported into the U.S., as well as fruits and vegetables brought in by travelers, with certain exceptions.

APHIS now states that it is considering adopting only a portion of this August 2001 proposed rule in order to require a phytosanitary certificate for fruits and vegetables imported in air passenger baggage for personal use.

APHIS Risk Assessment Considers Impact of Requiring Certificate for Fruits and Vegetables Imported in Air Passenger Baggage

In addition, APHIS states that it has prepared a risk assessment on this limited portion of the proposed rule. Specifically, the risk assessment issued by APHIS considers the plant pest risks associated with fruits and vegetables imported in air passenger baggage and the probable impact of phytosanitary certification requirements.

If, after considering comments received in response to this risk assessment, APHIS still believes this to be an appropriate course of action, it anticipates issuing a final rule to require phytosanitary certificates for fruits and vegetables imported for personal use by air passengers. APHIS states that it may at some future time reconsider some of the other provisions discussed in the original proposed rule.
