ITC Issues Final Report on Proposed HTS Changes for January 1, 2007 (Part XIV - HTS Chapters 52-54)

The International Trade Commission (ITC) has issued a final report to the President in connection with its investigation of proposed modifications to the Harmonized Tariff Schedule (HTS) that are expected to take effect on January 1, 2007.

This final report, entitled, Proposed Modifications to the Harmonized Tariff Schedule of the U.S., is part of ITC investigation number 1205-6 which was instituted in September 2004, in conjunction with the third review cycle of the International Convention on the Harmonized Commodity Description and Coding System (HS).

This is Part XIV of a multi-part series of summaries on the ITC's final report. Part XIV highlights the proposed changes to HTS Chapters 52 through 54 as set forth in Appendix B. See ITC report for duty rates; future issues of ITT for additional summaries.

Proposed Changes to HTS Chapters 52 through 54

Appendix B of the ITC final report sets forth the following proposed changes for HTS Chapters 52 through 54 (see report for complete details):

Chapter 52:Cotton

  1. 8.53.00 would be deleted
  2. 8.59.10 would be added

article description of 5208.59.20 would be amended to read "Satin weave or twill weave, other than 3-thread or 4-thread twill or cross twill"

  1. 0.12.00 would be deleted
  2. 0.19.10 would be added

article description of 5210.19.20 would be amended to read "Satin weave or twill weave, other than 3-thread or 4-thread twill or cross twill"

  1. 0.22.00 would be deleted
  2. 0.29.10 would be added

article description of 5210.29.20 would be amended to read "Satin weave or twill weave, other than 3-thread or 4-thread twill or cross twill"

  1. 0.42.00 would be deleted
  2. 0.49.10 would be added

article description of 5210.49.20 would be amended to read "Satin weave or twill weave, other than 3-thread or 4-thread twill or cross twill"

  1. 0.52.00 would be deleted
  2. 0.59.10 would be added
  3. 0.59.20 would be amended to read as "Satin weave or twill weave, other than 3-thread or 4-thread twill or cross twill"
  4. 1.21.00, 5211.22.00 and 5211.29.00 would be superseded by 5211.20, 5211.20.21, 5211.20.22 and 5211.20.29

Chapter 53:Other vegetable textile fibers; paper yarn and woven fabric of paper yarn

  1. 4, 5304.10.00 and 5304.90.00 would be deleted
  2. 5 and 5305.11.00 through 5305.90.00 would be superseded by 5305.00.00

Chapter 54:Man-made filaments

title to chapter 54 would be modified by deleting the expression "Man-made filaments" and substituting "Man-made filaments; strip and the like of man-made textile materials"

Note 1 to chapter 54 would be amended as follows:

- the second paragraph would be superseded by the following text "The terms "synthetic" and "artificial", used in relation to fibers, mean: synthetic: fibers as defined at (a); artificial: fibers as defined at (b). Strip and the like of heading 5404 or 5405 are not considered to be man-made fibers."
  1. 2.10 through 5402.10.60 would be superseded by 5402.11, 5402.11.30, 5402.11.60, 5402.19, 5402.19.30 and 5402.19.60
  2. 2.34, 5402.34.30 and 5402.30.60 would be added
  3. 2.44 through 5402.44.90 would be added

article description of 5402.41 would be superseded by: "Other, of nylon or other polyamides"

  1. 2.41, 5402.41.10 and 5402.41.90 would be renumbered as 5402.45, 5402.45.10 and 5402.45.90, respectively

article description of 5402.42.00 would be superseded by: "Other, of polyesters, partially oriented"

  1. 2.42.00 would be renumbered as 5402.46.00

article description of 5402.43 would be superseded by: "Other, of polyesters"

  1. 2.43, 5402.43.10 and 5402.43.90 would be renumbered as 5402.47, 5402.47.10 and 5402.47.90, respectively
  2. 2.48.00 would be added
  3. 2.49.10 and 5402.49.90 would renumbered as 5402.49.11 and 5402.49.91, respectively
  4. 3.20 through 5403.20.60 would be deleted
  5. 3.39.00 would be superseded by 5403.39, 5403.39.10 and 5403.39.90
  6. 3.49.00 would be superseded by 5403.49, 5403.49.10 and 5403.49.90
  7. 4.10 through 5404.10.80 would be superseded by 5404.11.00, 5404.12, 5404.12.10, 5404.12.90, 5404.19, 5404.19.10 and 5404.19.80
  8. 6, 5406.10.00 and 5406.20.00 would be superseded by 5406.00.00
