CBP Notices on August 2006 Increases to FY 2006 Refined and Specialty Sugar TRQs

U.S. Customs and Border Protection has issued two quota bulletins on recent or upcoming increases to (i) the refined sugar tariff rate quota (TRQ) and (ii) the specialty sugar TRQ, for fiscal year 2006 (October 1, 2005 - September 30, 2006), as follows:

August 7, 2006 Increase to FY 2006 Refined Sugar TRQ

Effective Monday, August 7, 2006, at 1:00 p.m. EDT or its equivalent in other time zones, CBP states that the U.S. Department of Agriculture has increased the FY 2006 refined sugar TRQ (non-specialty sugar component) by 90,719,000 kilograms (kg).

From this amount, the U.S. Trade Representative allocated 26,681,000 kg to Mexico (raw and refined, Certificate of Quota Eligibility required1) and 64,038,000 kg to the global refined sugar quota (no CQE required).

Special instructions for the refined sugar increase include the requirement that any shipments under the global portion must be in containers of 120,000 kilograms or less.

August 17, 2006 and August 31, 2006 Increases to FY 2006 Specialty Sugar TRQ

Effective Thursday, August 17, 2006, at 1:00 p.m. EDT or its equivalent in other time zones, CBP states that the FY 2006 specialty sugar TRQ will be increased by 4,500,000 kg, and that this increase is expected to fill at opening moment.

Also, effective Thursday, August 31, 2006, at 1:00 p.m. EDT or its equivalent in other time zones, CBP states that the FY 2006 specialty sugar TRQ will again be increased by 4,500,000 kg.

According to CBP, a specialty sugar certificate is required to claim the in-quota (low) duty rate.

CBP advises filers that it would not be advantageous to file entries for specialty sugar utilizing the Automated Clearing House (ACH) as the method of payment, as the filer would be locked into paying the total amount of duty for the quantity of specialty sugar originally presented for entry.

However, based on the earlier CBP statement that a CQE is required for Mexico, and an earlier USTR notice on this increase, it is expected that this is a CBP editing error.
