CBP Issues ABI System Requirements for Filing "Certificate of Eligibility" for Nicaragua Apparel DR-CAFTA TPL (ACS Programming Not Yet Completed)

U.S. Customs and Border Protection (CBP) has issued an ABI administrative message advising the trade on the ABI system requirements for the Certificate of Eligibility for the CAFTA-DR1 Tariff Preference Level (TPL)2 for Nicaragua apparel entered under HTS 9915.61.01.

ACS Programming for Nicaragua Certificate of Eligibility Expected to be Completed Within 2 Weeks

According to the administrative message and CBP sources, ACS is being programmed for the Certificate of Eligibility for Nicaragua DR-CAFTA TPL apparel entered under HTS 9915.61.01. This programming is expected to be completed within 2 weeks. A future message will inform the trade when they can begin transmitting the certificate number through the ABI system.

(Until the certificate number can be transmitted via ABI, CBP has previously stated that filers can file ABI and manually include the certificate number on the CF 7501. According to CBP, its field personnel will manually input the certificate number.)

ABI System Requirements for Nicaragua TPL Certificate of Eligibility

CBP states that the following are the system requirements for the Nicaragua TPL Certificate of Eligibility:

HTS 9915.61.01 will have a permit indicator of '10' to indicate that it is subject to the Nicaragua Certificate of Eligibility requirement.

The Nicaragua Certificate of Eligibility will be a 9 position alpha/numeric data element. The first position of the certificate will be a numeric representing the year of presentation. The second and third positions of the certificate will represent the country of origin which in this case would be ISO code 'NI' (Nicaragua). Positions 4-9 of the certificate will be an alpha/numeric data element.

The Nicaragua Certificate of Eligibility will be reported in the entry summary (EI) 52 Record (Input) in the Miscellaneous Permit/License field (positions 30-38).

The Nicaragua Certificate of Eligibility will be required for entry types 01, 02, 03, 06, 07, 11, 12, and warehouse withdrawal entry types 31, 32, 34, and 38. The certificate will be optional for warehouse entry types 21/22 and for temporary importation bond (TIB) entry type 23.

The Nicaragua Certificate of Eligibility will be displayed in block 34 of the 7501, next to the visa number field.

The effective date for reporting Nicaragua Certificate of Eligibility numbers in the Miscellaneous Permit/License field will be based on a future duty computation date indicated for HTS 9915.61.01. (The CATAIR, Entry Summary Section, Record Identifier 10, Note 3, describes how to determine the duty computation date for an entry summary.)
