Final negative critical circumstances finding. In addition, the ITA continues to find that critical circumstances do not exist with regard to imports of subject merchandise from Indonesia.
CV suspension of liquidation/CV bond/cash deposit requirement still discontinued. The ITA previously instructed U.S. Customs and Border Protection (CBP) to discontinue the CV suspension of liquidation and CV bond/cash deposit requirement for merchandise with a time of entry on or after June 13, 2006 (as a certain deadline had passed), but to continue the CV suspension of liquidation/CV bond/cash deposit requirement for entries made between February 13, 2006, and June 12, 2006, inclusive.
CBP stated that the CV suspension of liquidation will not be resumed and a CV cash deposit will not be required unless and until the ITA publishes a CV duty order. (See ITT's Online Archives or 06/22/06 news, 06062245, for BP summary of a CBP administrative message discontinuing the CV suspension of liquidation and CV cash deposit/bond requirements for subject merchandise from Indonesia.)
CV rates if order issued. The ITA and sources state that if the International Trade Commission (ITC) issues a final affirmative injury determination, the ITA will issue a CV order that again suspends liquidation. The order will also require a cash deposit of estimated CV duties for entries of subject merchandise at the revised CV duty rates listed below:
Company
PT. Pabrik Kertas Tjiwi Kimia Tbk
All Others
AD suspension of liquidation & AD cash deposit/bond requirements unaffected. CBP has previously indicated that the discontinuation of the CV suspension and CV cash deposit/bond requirements do not affect the antidumping (AD) suspension of liquidation and AD cash deposit/bond requirements for the companion AD duty investigation on certain lined paper products from Indonesia.
Note on the scope of the investigation. The scope of investigation in the final CV duty determination includes two additional HTS numbers under which the merchandise subject to this CV duty investigation may be imported-HTS 4820.10.2010 and 4820.10.2020.
(See ITA's notice for additional information, including the scope of the investigation, etc. See ITT's Online Archives or 03/22/06 news, 06032235, for BP summary of the alignment of the final AD and CV duty determinations on subject merchandise from India and Indonesia.
