AD: Turkey Certain Welded Carbon Steel Pipe and Tube
The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty new shipper review of certain welded carbon steel pipe and tube from Turkey for the review period of May 1, 2004 through April 30, 2005.

Bonding is No Longer Permitted
As a result, the ITA states that bonding will no longer be permitted to fulfill security requirements for shipments of subject merchandise from Turkey that are manufactured and exported by Toscelik with a time of entry on or after August 1, 2006.
For shipments with a time of entry on or after August 1, 2006, the ITA has determined the following AD cash deposit rates apply:

(a) The ITA has found that an AD duty rate of zero exists for Toscelik; as a result, no AD cash deposit is required; however, suspension of liquidation will continue;
(b) The AD cash deposit rate for exporters who received a rate in a prior segment of the AD proceeding will continue to be the rate assigned in that segment of the proceeding;
(c) The AD cash deposit rate for entries of subject merchandise exported by Toscelik but not manufactured by Toscelik will continue to be the "All Others" rate (i.e., 14.74%) or the rate applicable to the manufacturer, if so established; and
(d) If neither the exporter nor the producer is a firm covered in this review or a prior segment of the AD proceeding, the AD cash deposit rate will be 14.74%, the "All Others" rate established in the original AD investigation.
Assessment Instructions
The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of August 1, 2006.
Additionally, the ITA states it has calculated importer-specific duty assessment rates for subject merchandise, which according to trade sources, may differ significantly from the AD cash deposit rates listed above (which are weighted averages).
A recent law (Public Law 109-280) has suspended the option that allows importers to post bond for estimated AD or countervailing (CV) duties until the completion of a new shipper review (excluding new shipper reviews involving goods of Canada or Mexico).
