Antidumping Duty Proceedings
If it does not receive, by September 30, 2006, a request for an administrative review of entries covered by an AD or CV duty order listed above for the identified review period, the ITA will instruct U.S. Customs and Border Protection (CBP) to assess AD or CV duties on those entries at a rate equal to the cash deposit of (or bond for) estimated AD or CV duties required on those entries at the time of entry, or withdrawal from warehouse, for consumption and to continue to collect the cash deposit previously ordered.
ITA Clarifies Policy on Assessing AD Rates for Certain Resellers/Intermediaries
The ITA further notes that in May 2003 it clarified its practice with respect to the collection of final AD duties on imports of merchandise (from countries other than NME countries) where intermediate firms are involved. The ITA states that the public should be aware of this clarification in determining whether to request an administrative review of merchandise subject to AD orders.
