ITA Publishes Lists of Recently Completed, Pending, Etc. AD and CV Duty Scope Rulings and Anticircumvention Inquiries

The International Trade Administration (ITA) has published its lists of recently completed antidumping (AD) and countervailing (CV) duty scope rulings and anticircumvention determinations; terminated scope and anticircumvention inquiries; and pending scope and anticircumvention inquiries.

The ITA's lists include the country, case reference number, requestor(s), and a brief description of either the ruling or product subject to the request. The ITA notes that subsequent lists will follow after the close of each calendar quarter.

List of Pending and Recently Completed Rulings and Inquiries, Etc.

Listed below are the country, product, case number, and status for each of the AD and CV cases in the ITA's notice (note the "status legend" at the end of the list).

Several of the AD and CV cases listed below have more than one completed, terminated, and/or pending ruling and/or inquiry. In addition, the numerical notes below "highlight" some of the rulings and inquiries.

1 One completed scope ruling found that Polycast Series 700 Frame and Grate are not within the scope of the AD duty order.

2 Four completed scope rulings found that (1) certain "Christmas Stocking Tealight," "Halloween Novelty Ghost," "Halloween Novelty JOL," and "Halloween Novelty Frankenstein" candles are within the scope of the AD duty order; "Halloween Novelty Pumpkin," "Halloween Bloody Skull," "Halloween Novelty Tombstone," "Halloween Witch Shoe," and "Santas Boot" candles are not within the scope of the AD duty order; (2) certain small and large "Artichoke," small and large "Pinecone," "Cabbage," and "Radishes" candles are not within the scope of the AD duty order; (3) a certain "Santa Head" candle is within the scope of the AD duty order; and (4) a certain "Berry Ball Candle" is within the scope of the AD duty order.

3 One completed scope ruling found that gooseneck, claw and wrecking bars are not within the scope of the AD duty order.

4 Two completed scope rulings found that (1) certain infant (baby) changing tables with drawers or doors are within the scope of the AD duty order; certain infant (baby) changing tables with no drawers or doors and with the flat top surface surrounded by a permanent guard rail, and toddler beds are not within the scope of the AD duty order; and (2) a certain bathroom vanity is within the scope of the AD duty order.

5 One completed anticircumvention determination found that candles composed of petroleum wax and over fifty percent or more palm and/or other vegetable oil-based waxed are later-developed merchandise circumventing the AD duty order. 6 One pending anticircumvention inquiry on whether candles assembled in the U.S. from molded or carved articles of wax (wax forms) from China are circumventing the AD duty order. 7One pending anticircumvention inquiry on whether imports of tissue paper from Vietnam made out of jumbo rolls of tissue paper from China are circumventing the AD duty order.
