CV: Korea Stainless Steel Sheet and Strip in Coils

The International Trade Administration (ITA) has issued its preliminary results of a countervailing (CV) duty changed circumstances review for stainless steel sheet and strip in coils from Korea.

ITA Preliminary Determines that INI Cash Deposit Rate Applies to Hyundai

The ITA has preliminarily determined that the current CV cash deposit rate applicable to INI Steel Company (INI) shall be applicable to entries of subject merchandise made by Hyundai Steel Company (Hyundai), entered on or after the publication date of the final results of this CV changed circumstances review.

If these preliminary results are adopted in the final results, the ITA will instruct U.S. Customs and Border Protection (CBP) to collect a CV duty cash deposit at the rate of 0.54% ad valorem on all entries of subject merchandise produced and/or exported by Hyundai on or after the date of publication of the final results of this review.

(The ITA had previously preliminarily determined in the antidumping (AD) changed circumstances review of subject merchandise that Hyundai is the successor-in-interest to INI. However, the ITA stated in its initiation of this CV duty changed circumstances review that the successor-in-interest test for AD purposes may not fully address whether it is appropriate to apply the CV duty cash deposit rate of a previously examined company to its claimed successor. Therefore, the ITA states that it intends to further consider the issue of whether alternative or additional successorship criteria are appropriate in the CV duty context, and that it anticipates releasing a future Federal Register notice requesting comments on this issue.)
