ITA Publishes Lists of Recently Completed, Pending, Etc. AD and CV Duty Scope Rulings and Anticircumvention Inquiries

The International Trade Administration has published its lists of recently completed antidumping and countervailing duty scope rulings and anticircumvention determinations; terminated scope inquiries; and pending scope inquiries and anticircumvention rulings.

The ITA's lists include the country, case reference number, requestor(s), and a brief description of either the ruling or product subject to the request. The ITA notes that subsequent lists will follow after the close of each calendar quarter.

List of Pending and Recently Completed Rulings and Inquiries, Etc.

Listed below are the country, product, case number, and status for each of the AD and CV cases in the ITA's notice (note the "status legend" at the end of the list).

Several of the AD and CV cases listed below have more than one completed, terminated, and/or pending ruling and/or inquiry. In addition, the numerical notes below "highlight" some of the rulings and inquiries.

1Three completed scope rulings found that (1) a certain musical candle is included within the scope of the AD duty order; (2) the Wedding Cake, Wedding Carriage, Bride & Groom Wedding Cake Topper, Wedding Bells, and Pillow with Rings candles from a "Wedding Candle" series, and the Champagne Bottle in Ice Bucket from a "Holiday Candle" series, are not within the scope of the AD duty order; and (3) certain flip flops, wedding cake, baby bottle, pears, rubber duckie, coach, baby carriage, and teddy bear on a rocking horse candles are not within the scope of the AD duty order.

2Two completed scope rulings found that (1) a certain 10-ton log splitter is not within the scope of the AD duty order; and (2) the Tow Behind Log Splitter is not within the scope of the AD duty order.

3One completed scope ruling found that Pendaflex Pile Smart Label Clips are not within the scope of the AD duty order.

4One completed scope ruling found that certain products in a "Manhattan Collection" (which consist of a bench, computer cart, bookcase, modular room divider and desk) are not within the scope of the AD duty order.

5Two completed scope rulings found that (1) certain "non-typical" and "grizzly" deer carts are not within the scope of the AD duty order; and (2) the Stebco portable slide-flat cart is included in the scope of the AD duty order.

6Two completed scope rulings found that (1) certain printed educational materials (Blank Writing Journal; Writing Journal; Diario para Escribir; Vacation Journal; Science Journal; My Math Journal; Math Journal, Grades 4-6; Poetry Journal; Improve Your Writing Word Blank Journal; Stamp, Draw & Write Story Center; Letter Writing Supply Kit; Reading Journal; Cursive Writing Letter Practice Book; 1 to 30 Printing Numbers Practice Book; Lowercase Printing Letters Practice Book; and Uppercase Printing Letters Practice Book) are not within the scope of the AD duty order; and (2) certain padfolios which contain one pad of paper (whether or not the pad of paper meets the description of merchandise covered by the scope of the order) are not within the scope of the AD duty order.

7One completed scope ruling found that certain iron construction castings made of gray and ductile cast iron are included within the scope of the AD and CV duty orders.

8One completed anticircumvention determination found that certain candles assembled in the U.S. from molded or carved articles of wax (aka wickless wax forms) from China are circumventing the AD duty order. 9One pending anticircumvention ruling on whether imports of tissue paper from Vietnam made out of jumbo rolls of tissue paper from China are circumventing the AD duty order.
