AD: China Circular Welded Carbon Quality Steel Pipe

The International Trade Administration has made a preliminary affirmative antidumping duty determination that circular welded carbon quality steel pipe (CWP) from China is being, or is likely to be, sold in the U.S. at less than fair value.

Combination rates. The ITA stated in its initiation notice that it would calculate combination rates for respondents that are eligible for a separate rate in this investigation. (See ITT's Online Archives or 04/11/05 news, (Ref: 05041110), for BP summary of an April 2005 policy bulletin outlining this change in practice with regard to combination rates.)

Critical circumstances, suspension of liquidation (except Yulong). The ITA has preliminarily determined that critical circumstances exist with respect to imports of CWP from China, and therefore it will instruct U.S. Customs and Border Protection to suspend liquidation of all entries of CWP from China (except that produced and exported by Yulong) with a time of entry on or after 90 days prior to January 15, 2008.

The ITA is directing CBP not to suspend liquidation of imports of CWP from China produced and exported by Jiangsu Yulong Steel Pipe Co. Ltd. (Yulong) with a time of entry on or after January 15, 2008, as it has calculated a margin of zero percent for Yulong.

AD cash deposit or bond (except Yulong). The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the AD rates listed below, for entries of subject merchandise from China on or after January 15, 2008 (except Yulong) for the following exporter/producer combinations and the China-wide entity:

(a) The ITA has calculated a preliminary AD duty rate of 0.00% for Yulong. As this is a preliminary determination, such a rate preliminarily excludes Yulong from the suspension of liquidation/cash deposit/bond requirements.

Postponement of Final AD Duty Determination

In addition, the ITA states that it is postponing its final AD duty determination for subject merchandise from China for 60 days and extending provisional measures from a four-month period to not more than six months. Accordingly, the ITA will make its final determination not later than 135 days after January 15, 2008.

Revisions to the Scope of the Investigation

The ITA has analyzed the comments of the interested parties regarding the scope of this investigation and, based upon those comments, revised the scope language to preliminarily adopt the following changes:

The following paragraph has been amended (changed language underlined):

"Pipe multiple-stenciled to a standard and/or structural specification and to any other specification, such as the American Petroleum Institute (API) API-5L specification, is also covered by the scope of this investigation when it meets the physical description set forth [in the scope] and also has one or more of the following characteristics: is 32 feet in length or less; is less than 2.0 inches (50 mm) in outside diameter; has a galvanized and/or painted surface finish; or has a threaded and/or coupled end finish."

The reference to grade "X-42" when referring to API 5L stenciled pipe has been removed.

The following paragraph regarding standard pipe applications has been removed:

"All pipe meeting the physical description set forth above that is used in, or intended for use in, standard and structural pipe applications is covered by the scope of this investigation. Standard pipe applications include the low-pressure conveyance of water, steam, natural gas, air, and other liquids and gases in plumbing and heating systems, air conditioning units, automatic sprinkler systems, and other related uses. Standard pipe may also be used for light load-bearing and mechanical applications, such as for fence tubing, and as an intermediate product for protection of electrical wiring, such as conduit shells. Structural pipe is used in construction applications."

An exclusion to the scope of the investigation has been added: "(d) finished scaffolding." The list of exclusions has also been reordered pursuant to this addition.

An exclusion to the scope of the investigation has been amended as follows (changed language underlined): "(g) line produced to only API specifications."
