AD: China Certain New Pneumatic Off-the-Road Tires

The International Trade Administration has made a preliminary affirmative determination that critical circumstances exist with respect to the China-wide entity in its antidumping investigation of certain new pneumatic off-the-road tires (OTR tires) from China.

Suspension of Liquidation for China-wide Entity Pushed Back 90 Days

With respect to the China-wide entity, the ITA will direct U.S. Customs and Border Protection to suspend liquidation of all unliquidated entries of OTR tires from China with a time of entry on or after November 22, 2007, which is 90 days prior to February 20, 2008 (the date of publication of its preliminary determination in the Federal Register).

For the mandatory respondents and the separate rate companies in this investigation, the ITA will make no changes to its instructions to CBP with respect to the suspension of liquidation of entries of subject merchandise from these companies with a time of entry on or after February 20, 2008. (The China-wide entity covers any company not listed as a mandatory or separate rate respondent in this investigation.)

Final Critical Circumstances to be Issued With Final Determination

The ITA will issue a final determination concerning critical circumstances for all exporters of subject merchandise from China when it issues its final determination in this AD investigation, which will be not later than July 7, 2008.

In the countervailing duty investigation of certain OTR tires from China, the ITA has issued a preliminary determination that critical circumstances do not exist with respect to imports of subject merchandise. Therefore, the suspension of liquidation instructions for the CV duty investigation remain the same for all entries of OTR tires from China with a time of entry on or after December 17, 2007.
