AD/CV: China and Canada Citric Acid, Certain Citrate Salts
The International Trade Administration has initiated antidumping duty investigations to determine whether imports of citric acid and certain citrate salts from China and Canada are being, or are likely to be, sold in the U.S. at less than fair value, and a countervailing duty investigation to determine whether manufacturers, producers, or exporters of subject merchandise in China receive countervailable subsidies.

China AD - Q&V Questionnaires Due May 27th, Separate Rate Apps Due July 14th
In the China AD investigation, the ITA will request quantity and value (Q&V) information from all known exporters and producers identified in the petition. The quantity and value data received from these non-market economy (NME) exporters/producers will be used as the basis to select the mandatory respondents. The ITA requests that Q&V questionnaires be submitted no later than May 27, 2008. The questionnaire is available at http://ia.ita.doc.gov/ia-highlights-and-news.html.
The ITA requires exporters and producers seeking separate rate status in the AD investigation for China to submit a separate rate application by July 14, 2008. The application is available at http://ia.ita.doc.gov/download/nme-sep-rates/prc-ca/prc-citric-acid-init-sra-050708.pdf.
China CV, Canada AD - Comments on CBP Data, RespondentsDue May 19, 23
The ITA states that for the China CV and Canada AD investigations, it intends to select respondents based on U.S. Customs and Border Protection data for U.S. imports during the period of investigation. The ITA invites comments regarding the CBP data and the selection of respondents within seven days of May 12, 2008 for the China CV investigation, and within ten days of May 13, 2008 for the Canada AD investigation.
Comments on Physical Characteristics Due May 27th
The ITA is also requesting comments by May 27, 2008 from interested parties regarding the appropriate physical characteristics of citric acid and certain citrate salts to be reported in response to the AD questionnaires. This information will be used to identify the key physical characteristics of the subject merchandise in order for respondents to more accurately report the relevant factors and costs of production, as well as to develop appropriate product comparison criteria. (Rebuttal comments must be received by June 3, 2008.)
Scope of the Investigations
The scope of these investigations includes all grades and granulation sizes of citric acid, sodium citrate, and potassium citrate in their unblended forms, whether dry or in solution, and regardless of packaging type. The scope also includes blends of citric acid, sodium citrate, and potassium citrate; as well as blends with other ingredients, such as sugar, where the unblended form(s) of citric acid, sodium citrate, and potassium citrate constitute 40 percent or more, by weight, of the blend.
The scope of these investigations also includes all forms of unrefined calcium citrate, including dicalcium citrate monohydrate, and tricalcium citrate tetrahydrate, which are intermediate products in the production of citric acid, sodium citrate, and potassium citrate. The scope of these investigations includes the hydrous and anhydrous forms of citric acid, the dihydrate and anhydrous forms of sodium citrate, otherwise known as citric acid sodium salt, and the monohydrate and monopotassium forms of potassium citrate. Sodium citrate also includes both trisodium citrate and monosodium citrate, which are also known as citric acid trisodium salt and citric acid monosodium salt, respectively.
HTS Classification. Citric acid and sodium citrate are classifiable under HTS 2918.14.0000 and 2918.15.1000, respectively. Potassium citrate and calcium citrate are classifiable under HTS 2918.15.5000. Blends that include citric acid, sodium citrate, and potassium citrate are classifiable under HTS 3824.90.9290.
The ITA notes that although the HTS subheadings are provided for convenience and customs purposes, the written description of the merchandise is dispositive.
