The International Trade Administration has made a final affirmative countervailing duty determination that countervailable subsidies are being provided to certain producers and exporters of laminated woven sacks (LWS) from China.

Critical Circumstances for All Mandatory Respondents
The ITA continues to find that critical circumstances exist for entries of LWS from mandatory respondents Han Shing Chemical and Ningbo. For purposes of this final determination, the ITA is also making an affirmative determination of critical circumstances with respect to the other two mandatory respondents, Qilu, and SSJ/SLP.
CV Liquidation Suspended Through March 31st
Han Shing Chemical or Ningbo.The ITA will instruct U.S. Customs and Border Protection to continue the CV suspension of liquidation for entries of LWS produced and/or exported by Han Shing Chemical or Ningbo with a time of entry from September 4, 2007 to March 31, 2008.
Qilu and SSJ/SLP.The ITA will instruct CBP to apply the previously ordered CV suspension of liquidation for Qilu and SSJ/SLP retroactively to any unliquidated entries with a time of entry from September 4, 2007 to March 31, 2008.
Aifudi, All Others.For the voluntary respondent, Aifudi and "All Others," the ITA will instruct CBP to continue the CV suspension of liquidation for entries with a time of entry from December 3, 2007 to March 31, 2008.
CV Liquidation Reinstated Beginning April 1st
The ITA previously instructed CBP to discontinue the CV suspension of liquidation/cash deposit/bond requirements for subject merchandise with a time of entry on or after April 1, 2008, but to continue these requirements for all entries prior to that date.
During this gap period, which began on April 1, 2008 and ends on the day before a CV order takes effect (if any), entries of subject merchandise will not be liable for CV duties.
CV Liquidation to be Suspended Again, Cash Deposit, if Final ITC Injury Found
If the ITC issues a final affirmative CV injury determination, (or threat thereof, or that a U.S. industry is materially retarded by imports of subject merchandise) the ITA will then issue a CV duty order, reinstate the CV suspension of liquidation, and require a cash deposit of estimated CV duties for entries of subject merchandise at the rates listed below:
(If the ITC determines that such injury, etc. does not exist, the CV proceeding will be terminated and all securities posted will be refunded or canceled.)

Scope of the Investigation
