CBP Issues ABI System Requirements for Additional Softwood Lumber Data Elements

U.S. Customs and Border Protection has issued a CSMS message providing the Automated Broker Interface (ABI) system requirements for the additional trade data elements associated with softwood lumber products as required by the Farm Bill of 2008.

Farm Bill Requires the Trade to Submit Export Price, Export Charges, Etc.

According to CBP, the Farm Bill requires the trade to submit the following additional trade data elements associated with softwood lumber:

  • export price
  • export charges
  • importer declaration indicator

(CBP notes that Sections 802 and 803 of the Farm Bill define the softwood lumber export price1, softwood lumber export charges2 and importer declaration3 that the importer is required to submit for softwood lumber products.)

EI Record Identifier 52 to be Modified to Accept the New Data Elements

The Entry Summary (EI) Record Identifier 52 record will be modified to accept the new data elements in the following manner:

The above data elements should be reported in the following manner:

Export price - To report the export price, the filer will enter the numeric '01' in the other data indicator 1 field (positions 39-40). The numeric '01 indicates that the data entered in the other data element 1 field will represent the softwood lumber export price.

Softwood lumber importer declaration and the softwood lumber charges - To report the softwood lumber importer declaration and the softwood lumber charges, the filer will enter the numeric '01' in the other data indicator 2 field (positions 50-51). The numeric '01' indicates that the other data element 2 field will represent the information associated with the importer declaration and the export charges. The filer will enter 'Y' in position 52 and enter the export charges in positions 53-63.

(The following is an example in which the importer is making a softwood lumber declaration and reporting export charges of $5100: The filer will enter '01' in the other data indicator 2 field (positions 50-51) and enter 'Y00000005100' in the other data element 2 field (Y in position 52 represents the importer declaration and positions 53-63 represent the export charge).)

Softwood lumber export price - The softwood lumber export price (other data element 1) should be printed on the 7501 below the tariff number. The softwood lumber importer declaration and the softwood lumber export charges (other data element 2) should be printed next to the softwood lumber export price.

Softwood Tariff Numbers Subject to Reporting Have a Permit Indicator of '11'

Softwood lumber tariff numbers that are subject to the reporting of the above data elements have a permit indicator of '11' on the tariff record. The Harmonized Reference File Record Identifier 'V2', miscellaneous permit indicator field (positions 75 - 76) and the Harmonized Query Transaction Record Identifier 'W2' miscellaneous permit indicator field (positions 75 - 76) will display the permit indicator 11.

Data Elements Required for Certain Entry Types

According to CBP, the above data elements are required for the following entry types:

  • Consumption entry types: 01, 02, 03, 07
  • Foreign Trade Zone: 06
  • Warehouse entry types: 21, 22
  • Warehouse withdrawal entry types: 31, 32, 34, 38
  • Temporary importation bond: 23

ABI Changes Not Yet Completed

CBP states that ABI system changes to allow the trade to transmit the softwood lumber data elements have not been completed by CBP. The trade will be notified in a future message when the system changes are complete.

1Export price means either (i) in the case of softwood lumber or a softwood lumber product that has undergone only primary processing, the value that would be determined Free On Board (F.O.B.) at the facility where the product underwent the last primary processing before export; or (ii) in the case of softwood lumber or a softwood lumber product described in Section 802(5)(A)(ii)(II), the value that would be determined F.O.B. at the facility where the lumber or product underwent the last primary processing, etc.

2Export charges means any tax, charge, or other fee collected by the country from which softwood lumber or a softwood lumber product, described in Section 804(a), is exported pursuant to an international agreement entered into by that country and the U.S.

3Section 803 requires the establishment of a softwood lumber importer declaration program. The program shall require importers of softwood lumber and softwood lumber products described in Section 804(a) to provide certain information and declare the information, and require that such information accompany the entry summary documentation.
