AD/CV: China, Taiwan Raw Flexible Magnets

The International Trade Administration has published in the September 17, 2008 Federal Register antidumping duty orders on raw flexible magnets (RFM) from China and Taiwan; and a countervailing duty order on RFM from China.

AD/CV Cash Deposits/Bonds Refunded/Released for a Time of Entry Prior to Sept 2, 2008

On September 2, 2008, the International Trade Commission (ITC) published its final “threat” of material injury determination for RFM from China and Taiwan.

However, this final threat determination was not accompanied by a finding that injury would have resulted “but for” the imposition of suspension of liquidation of entries since the ITA’s preliminary determination.

With no “but for” finding, the ITA will instruct U.S. Customs and Border Protection (CBP) to terminatethe suspension of liquidation for RFM from China and Taiwan with a time of entry prior to September 2, 2008, and refund/release any cash deposits or bonds of estimated AD and CV duties posted prior to the September 2, 2008 publication of the ITC's final threat of material injury determination.

AD/CV Cash Deposit Requirements for a Time of Entry on or After Sept 2, 2008

In addition, the ITA indicates that effective for subject merchandise from China and Taiwan with a time of entry on or after September 2, 2008, CBP will require, at the same time as importers would normally deposit estimated duties, an AD and/or CV cash deposit, as applicable, at the rates listed below:

Assessment Instructions

The ITA states it will instruct CBP to assess AD and/or CV duties, as applicable, on all unliquidated entries of raw flexible magnets from China and/or Taiwan that have a time of entry on or after September 2, 2008 (the publication date of the ITC’s threat of injury determination).
