CV: China Citric Acid and Certain Citrate Salts

The International Trade Administration has made a preliminary affirmative countervailing duty determination that countervailable subsidies are being provided to producers and exporters of citric acid and certain citrate salts from China.

CV suspension of liquidation. The ITA is directing U.S. Customs and Border Protection to suspend the liquidation of all entries of subject merchandise from China with a time of entry on or after September 19, 2008.

CV cash deposit/bond. The ITA will also instruct CBP to require a cash deposit or the posting of a bond at the CV rates listed below for entries of subject merchandise with a time of entry on or after September 19, 2008 for the following exporters/manufacturers:

Scope of Investigation Modified by Adding an Exclusion, Etc.

The ITA has modified the scope of investigation by adding the following exclusion:

"The scope of this investigation does not include calcium citrate that satisfies the standards set forth in the U.S. Pharmacopeia and has been mixed with a functional excipient, such as dextrose or starch, where the excipient constitutes at least 2 percent,

by weight, of the product."

The ITA has also added a second tariff number to this sentence indicating where subject merchandise is classifiable (new text underlined):

Potassium citrate and crude calcium citrate are classifiable under HTS 2918.15.5000 and HTS 3824.90.9290, respectively.

Final CV Duty Determination Aligned with Final AD Duty Determinations

The ITA notes that it is aligning the final CV duty determination with the final determinations in the companion antidumping investigations of subject merchandise from China and Canada. The final CV duty determination will be issued on the same date as the final AD duty determinations, which are currently scheduled to be issued no later than January 26, 2009.
