CV: China Circular Welded Carbon Quality Steel Line Pipe

The International Trade Administration has made a final affirmative countervailing duty determination that countervailable subsidies are being provided to certain producers and exporters of circular welded carbon quality steel line pipe (line pipe) from China.

Suspension of Liquidation

The ITA has instructed U.S. Customs and Border Protection to continue the suspension of liquidation for all entries of line pipe from China with a time of entry on or after September 9, 2008.

CBP will also continue to collect CV duty cash deposits or bonds at the following CV duty rates (which are unchanged from the preliminary determination):

(If the International Trade Commission issues a final affirmative CV injury determination, the ITA will then issue a CV duty order. If the ITC determines that CV material injury or threat of material injury does not exist, the CV proceeding will be terminated and all securities posted will be refunded or canceled.)

Amended Exclusion Language in the Scope of the Investigation

The ITA has also amended the exclusion language that it added to the scope of the investigation in its preliminary determination as follows (added text underlined):

Excluded from this scope are pipes of a kind used for oil and gas pipelinesthat are multiple-stenciled to a standard and/or structural specification and to any other specification, such as the API-5L specification, when it also has one or more of the following characteristics: is 32 feet in length or less; is less than 2.0 inches (50 mm) in outside diameter; has a galvanized and/or painted surface finish; or has a threaded and/or coupled end finish. (The term "painted" does not include coatings to inhibit rust in transit, such as varnish, but includes coatings such as polyester.)
