ITA Publishes Lists of Recently Completed, Pending, Etc. AD and CV Duty Scope Rulings and Anticircumvention Inquiries

The International Trade Administration has published its quarterly list of recently completed antidumping and countervailing duty scope rulings and anticircumvention determinations; terminated scope and anticircumvention inquiries; and pending scope inquiries and anticircumvention rulings.

This ITA list includes scope rulings and anticircumvention determinations completed between July 1, 2008, and September 30, 2008, and scope inquiries and anticircumvention rulings pending as of September 30, 2008.

Examples of ITA Scope Rulings and Anticircumvention Determinations

The ITA issues scope rulings to determine whether a specific product is within the scope of an AD or CV duty order, and anticircumvention determinations to determine whether a specific product circumvents an AD or CV duty order.

Examples of completed scope rulings on the ITA's list include its determinations that certain textile-machinery components are not within the scope of the AD duty order on ball bearings and parts thereof from Germany; and certain novelty candles are not within the scope of the AD duty order on petroleum wax candles from China. The ITA also made a final anticircumvention determination that imports of tissue paper from Vietnam made out of jumbo rolls of tissue paper from China are circumventing the AD duty order on tissue paper products from China. An example of a pending scope inquiry includes whether certain TriClad nickel-clad stainless steel sheet and strip in coils is within the scope of the AD duty order on stainless steel sheet and strip in coils from Germany; and an example of a pending anticircumvention determination includes whether the common leg table produced in China is a minor alteration that circumvents the AD duty order on folding metal tables and chairs from China.
