ITA No Longer Exempts Certified Entries of Vietnam Tissue Paper Products from AD Anticircumvention Determination

Pursuant to an International Trade Administration anticircumvention determination1, U.S. Customs and Border Protection has issued an ADD/CVD message announcing that effective immediately, it is discontinuing the certification program with respect to all entries of certain tissue paper products produced by Vietnam Quijiang Paper Co. Ltd. with a time of entry on or after September 5, 2006.

(The products covered by the ITA's circumvention determination are jumbo rolls of tissue paper that are exported from China to Vietnam where they are converted, possibly dyed and/or printed, into tissue paper products. This determination covers only such products that are exported to the U.S. by Quijiang.)

Suspension of Liquidation/AD Cash Deposit of 112.64%

Until further notice, the ITA has instructed CBP to continue to suspend liquidation of any entries of subject tissue paper products produced by Quijiang with time of entry on or after September 5, 2006, and require a cash deposit of 112.64%.

Certification Program Previously Allowed Liquidation/No Cash Deposit for Certified Entries

Under the ITA's anticircumvention determination1, for all entries for which the U.S. importer submitted a certification from Quijiang that the merchandise was non-subject (i.e., of Vietnamese-origin and not produced using Chinese-origin jumbo rolls), CBP was directed to liquidate those entries without regard to AD duties. The ITA did not request that CBP suspend liquidation, or require a cash deposit, for any entries of tissue paper accompanied by the subject certification.

The ITA stated that if Quijiang elected not to participate in the expanded third administrative review or did not consent to verification of the certified entries, the ITA would immediately revoke the certification program and instruct CBP to suspend liquidation and collect cash deposits at the China-wide entity rate of 112.64% on all of Quijiang's entries of tissue paper, regardless of country of origin.
