ITC Institutes AD/CV Injury Investigations on Magnesia Carbon Bricks from China, Mexico

The International Trade Commission has announced the institution of investigations and the commencement of preliminary phase antidumping and countervailing duty injury investigations regarding certain magnesia carbon bricks (MCBs) from China and Mexico.

According to the press release, such MCBs are provided for in HTS subheadings 6902.10.10, 6902.10.50, 6815.91.00, and 6815.99.00.

These investigations are being instituted in response to a petition filed by Resco Products, Inc., of Pittsburgh, PA.

ITC to Determine if U.S. Industry is Injured

The ITC is instituting these investigations to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports from China and Mexico of certain MCBs. This product is also alleged to be subsidized by the Government of China.

ITC Must Reach Preliminary Injury Determination by September 14th

Unless the Department of Commerce extends the time for initiation, the ITC must reach a preliminary determination in AD and CV duty injury investigations in 45 days or, in this case, by September 14, 2009. The ITC's views are due at Commerce within five business days thereafter, or by September 21, 2009.
