AD/CV: China Aluminum Extrusions

The International Trade Commission has announced the institution of investigations and the commencement of preliminary phase antidumping and countervailing duty injury investigations regarding aluminum extrusions from China.

According to the press release, such aluminum extrusions are provided for in HTS subheadings 7604.21.00, 7604.29.10, 7604.29.30, 7604.29.50, and 7608.20.00.

These investigations are being instituted in response to a petition filed by the Aluminum Extrusions Fair Trade Committee and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union (USW).

ITC to Determine if U.S. Industry is Injured

The ITC is instituting these investigations to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports from China of certain aluminum extrusions, that are alleged to be sold in the U.S. at less than fair value and alleged to be subsidized by the Government of China..

ITC Must Reach Preliminary Injury Determination by May 17

Unless the Department of Commerce extends the time for initiation, the ITC must reach a preliminary determination in AD and CV duty injury investigations in 45 days or, in this case, by May 17, 2010. The ITC's views are due at Commerce within five business days thereafter, or by May 24, 2010.
