According to the press release, such glyphosate is provided for in HTS subheadings 2931.00.90 and 3808.93.50.
This investigation is being instituted in response to a petition filed by Albaugh, Inc., Ankeny, IA.
ITC to Determine if U.S. Industry is Injured
The ITC is instituting this investigation to determine whether there is a reasonable indication that an industry in the U.S. is materially injured or threatened with material injury, or the establishment of an industry in the U.S. is materially retarded, by reason of imports from China of glyphosate, that are alleged to be sold in the U.S. at less than fair value.
ITC Must Reach Preliminary Injury Determination by May 17
Unless the Department of Commerce extends the time for initiation, the ITC must reach a preliminary determination in this AD duty injury investigation in 45 days or, in this case, by May 17, 2010. The ITC's views are due at Commerce within five business days thereafter, or by May 24, 2010.
