CV: Vietnam Polyethylene Retail Carrier Bags

The International Trade Administration is issuing a countervailing duty order on polyethylene retail carrier bags (PRCBs) from Vietnam (C-552-805).

CV Liquidation and Refund Instructions

Because the International Trade Commission's final injury determination is based on the threat of material injury, the ITA will instruct U.S. Customs and Border Protection to terminate the CV suspension of liquidation for entries of PRCBs from Vietnam with a time of entry prior to April 30, 2010 (the publication date of the ITC’s final injury determination).

The ITA will also instruct CBP to refund any cash deposits made and release any bonds posted from September 4, 2009 through January 1, 2010.

(The ITA previously instructed CBP to discontinue the suspension of liquidation on January 2, 2010; therefore, liquidation was already reinstated for CV duty purposes for entries of PRCBs made on or after January 2, 2010, and prior to the date of publication of the ITC’s final determination.)

CV Suspension of Liquidation Reinstated April 30

Suspension of liquidation is reinstated for CV duty purposes for all entries of PRCBs from Vietnam with a time of entry on or after April 30, 2010.

CV Cash Deposit Requirements

The ITA will also instruct CBP to require, at the same time as importers would normally deposit estimated duties, CV duty cash deposits (except Chin Sheng) at the rates specified below for entries of PRCBs from Vietnam with a time of entry on or after April 30, 2010 (which are unchanged from the final determination):
