ITA Fact Sheet on Final AD/CV Rates for China Potassium Phosphate Salts

The International Trade Administration has issued a fact sheet announcing its affirmative final determinations in the antidumping and countervailing duty investigations of certain potassium phosphate salts from China (A-570-962 and C-570-963) .

As a result of the final AD and CV duty determinations, the ITA will instruct U.S. Customs and Border Protection to continue to collect cash deposits or bonds based on the final AD and CV duty rates below.

Final AD Rates Range from 69.58% to 95.40%

In the AD investigation, the ITA has found that Chinese producers/exporters have sold certain potassium phosphate salts in the U.S. at 69.58% to 95.40% less than fair value.

Mandatory respondents, SD BNI (LYG) Co. Ltd. and SiChuan Blue Sword Import & Export Co., Ltd. failed to submit the information required and as a result, the ITA has assigned both mandatory respondents a rate of 95.40% as part of the China-wide entity for the final determination.

Four companies qualified for a separate AD duty rate of 69.58%. All other exporters will receive a China-wide entity rate of 95.40%.

Final CV Rate of 109.11%

In the CV investigation, the ITA has determined that Chinese producers/exporters of certain potassium phosphate salts have received net countervailable subsidies of 109.11%.

The CV duty rates for mandatory respondents Lianyungang Mupro Import Export Co, Ltd.; Mianyang Aostar Phosphate Chemicals Industry Co., Ltd.; and Shifang Anda Chemicals Co., Ltd. are based on adverse facts available because both the government of China and these respondents did not cooperate in the investigation. Therefore, they will receive the all others rate of 109.11%.

ITC to Issue Final Injury Determinations in July 2010

The ITC is scheduled to issue its final injury determinations on or before July 8, 2010. If the ITC makes affirmative determinations that imports of certain potassium phosphate salts from China materially injure, or threaten material injury to, the domestic industry, the ITA will issue AD and CV duty orders.
