1The ITA has found a de minimis CV duty rate of 0.44% for De Cecco Pastificio/De Cecco Pescara, therefore, no cash deposit is required; however, it remains subject to the order.
Assessment Instructions
The ITA intends to issue appropriate assessment instructions to CBP 15 days after June 29, 2010. Because the CV duty rate for De Cecco Pastificio/De Cecco Pescara is de minimis, the ITA will instruct CBP to liquidate shipments of certain pasta by this entity during the review period without regard to CV duties.
For all entries by Garofalo, De Matteis Agroalimentare S.p.A., Agritalia S.r.L., and F. Divella S.p.A., the ITA will instruct CBP to assess CV duties on all shipments at the net subsidy rates listed above.
For all other companies that were not reviewed (except Barilla G. e R. F.lli S.p.A., and Gruppo Agricoltura Sana S.r.l., which are excluded from the order, and Pasta Lensi S.r.l., which was revoked from the order), the ITA has directed CBP to assess CV duties on all entries at the rates in effect at the time of entry.
(See ITA notice for more information, including the scope of the order, etc.
See ITT's Online Archives or 04/14/10 news, 10041442, for BP summary of the preliminary results of this review.)
