Vietnam Shrimp: Initiation and Prelim Results of AD Changed Circumstances Review
The International Trade Administration is initiating and issuing the preliminary results of an antidumping duty changed circumstances review of certain frozen warmwater shrimp from Vietnam.

This review has been initiated to determine whether Phuong Nam Foodstuff Corp. is the successor-in-interest to Phuong Nam Co., Ltd. for purposes of determining AD duty liability.
ITA Preliminarily Finds Phuong Nam Foodstuff is Successor-in-Interest
The ITA preliminarily determines that that Phuong Nam Foodstuff Corp. is the successor-in-interest to Phuong Nam Co., Ltd., and, as a result, should be accorded the same treatment previously accorded to Phuong Nam Co., Ltd. (currently de minimis).

Phuong Nam Foodstuff Would Receive De Minimis Rate if Finalized
If the ITA’s final results remain the same as these preliminary results, effective the date of publication of the final results, it will instruct U.S. Customs and Border Protection to assign entries of merchandise produced or exported by Phuong Nam Foodstuff Corp. the de minimis AD duty cash deposit rate currently applicable to Phuong Nam Co., Ltd.
(Note that there is an administrative review pending for Phuong Nam, for which preliminary results have been issued, and would assign Phuong Nam a 2.89% AD duty rate if finalized. See ITT’s Online Archives or 03/17/10 news, 10031760, for BP summary of these preliminary results.)
