(This review was initiated to determine whether Far Eastern New Century Corporation (FENC) is the successor-in-interest to Far Eastern Textile Limited (FET) for purposes of determining AD duty liability.)
FENC Receives FET’s 1.97% AD Duty Rate
The ITA continues to find that FENC is the successor-in-interest to FET and, as a result, FENC should be accorded the same treatment as FET for AD duty purposes.
Therefore, the ITA will instruct U.S. Customs and Border Protection to collect AD duty cash deposits at 1.97%, the AD duty rate found for FET in the most recently completed review. (See ITT’s Online Archives or 04/22/09 news, 09042240, for BP summary.)
