China New Pneumatic Tires: 1 Firm No Longer Excluded from AD Order
The International Trade Administration has issued an amended final antidumping duty determination for certain new pneumatic off-the-road from China in order to include a firm that was previously excluded from the AD duty order, pursuant to a final court decision.

Tires Exported/Produced by Xugong No Longer Excluded from Order
While merchandise produced and exported by Xuzhou Xugong Tyres Co., Ltd. was originally excluded from the order as it was found to have an AD duty rate of zero, the ITA’s redetermination on remand (ordered by the Court of International Trade) found that merchandise exported and produced by Xugong was, in fact, sold at less than fair value.
As there is now a final and conclusive court decision, the ITA is amending its final determination and AD duty order, and Xugong is no longer excluded from the order.
AD Suspension of Liquidation for Xugong Effective May 24
The ITA has instructed U.S. Customs and Border Protection to begin suspension of liquidation, effective for entries on or after May 24, 2010, with respect to subject merchandise produced and exported by Xugong.
AD Cash Deposit Requirements for Xugong
The ITA will also instruct the CBP to collect an AD duty cash deposit for entries of subject merchandise produced and exported by Xugong, effective for entries on or after May 24, 2010, at the following amended AD duty rate:
