Updated 2010 HTS Reflecting MTB Changes, Etc. to Soon be Posted by ITC

The International Trade Commission is expected to soon post an updated electronic version of the 2010 Harmonized Tariff Schedule (Revision 2) to its Web site. One source indicated that Revision 2 would be posted by August 26, 2010.

(In early July 2010, the ITC posted a July 1, 2010 electronic version of the HTS (Revision 1) to its Web site. Revision 1 reflects Generalized System of Preferences, Costa Rica sugar, free trade agreement, 484f Committee, etc. changes to the tariff schedule. MTB Changes to be Reflected in Revision 2

Revision 2 will contain changes to reflect the extension, modification, and creation of numerous HTS 9902 tariff numbers that suspend or reduce the duty on hundreds of imported products. These changes take effect for goods entered or withdrawn from warehouse for consumption on or after August 26, 2010.

The HTS 9902 provisions in the enacted bill that had expired on December 31, 2009 are provided retroactive benefits if requests are filed with CBP within 180 days after August 11, 2010 and contain sufficient information, etc.

(If Revision 2 is posted before August 26, 2010, the ITC HTS Web page is expected to note that the MTB changes do not take effect until August 26, 2010.)

Revision 2 is also expected to include any other changes to the HTS that have taken effect since Revision 1 was posted to the ITC Web site.

GPO Not Expected to Print Any Paper 2010 Supplements

The Government Printing Office has sent a letter to HTS subscribers announcing that due to the relatively minor nature of the July changes to the 2010 HTS, the ITC has decided not to issue a paper July 2010 supplement for the 2010 HTS.

ITC sources have stated by phone that they do not expect to issue any other printed revisions to the 2010 HTS, and the next paper version they expect to issue will be for 2011.

(The HTS 9902 changes result from the enactment of H.R. 4380, the U.S. Manufacturing Enhancement Act of 2010 (also known as the Miscellaneous Trade and Technical Corrections Act of 2009, or Omnibus MTB), which became law on August 11, 2010.
