FY 2011 CBTPA TPLs for T-Shirts, Knit Apparel

U.S. Customs and Border Protection is announcing the fiscal year 2011 tariff preference level quantities of certain T-shirts and knit-to-shape (knit) apparel articles that are eligible to receive duty-free treatment if imported directly from any current or former Caribbean Basin Trade Partnership Act (CBTPA) beneficiary country.

TPLs Open October 1st

The opening date for these TPLs is October 1, 2010, with the TPLs endings on September 30, 2011. The duty-free limits are as follows:

Certain knit apparel (HTS 9820.11.09)970,000,000 SME
Certain T-shirts ( HTS 9820.11.12)12,000,000 dozen

Description of CBTPA TPLs

CBP’s memo and the HTS provide the following description of the goods subject to these CBTPA TPLs:

9820.11.09: Apparel articles (other than socks provided for in HTS heading 6115) knit to shape in a designated (current or former) CBTPA beneficiary country from yarns wholly formed in the U.S.; knitted or crocheted apparel articles (except T-shirts, other than underwear, classifiable in subheadings 6109.10.00 and 6109.90.10 and described in subheading 9820.11.12) cut and wholly assembled in one or more such countries from fabrics formed in one or more such countries or from fabrics formed in one or more such countries and the U.S., all the foregoing from yarns wholly formed in the U.S. (including fabrics not formed from yarns, if such fabrics are classifiable in HTS heading 5602 or 5603 and are formed in one or more such countries)

Besides certain HTS Chapter 61 apparel, CBP's memo states that this TPL also includes HTS 6212, HTS 6406.99.15, 6505.90.1515, 6505.90.1525, 6505.90.1540, 6505.90.1560, 6505.90.3030, 6505.90.3045, 6505.90.3090, 6505.90.5030, 6505.90.5045, 6505.90.5090, 6505.90.6030, 6505.90.6040, 6505.90.6045 and 6505.90.6090.

9820.11.12: T-shirts, other than underwear, classifiable in HTS 6109.10.0012, 6109.10.0014, 6109.10.0040, 6109.10.0045, 6109.90.1007, 6109.90.1009, 6109.90.1050, and 6109.90.1060 made in one or more designated (current or former) CBTPA beneficiary countries from fabric formed in one or more such countries from yarns wholly formed in the U.S.

CBP states that if a TPL fills, such T-shirts and apparel articles may enter at the otherwise applicable duty rate. (According to August 30, 2010 data, the FY 2010 TPL for knit apparel is 12.42% filled, and the non-underwear T-shirt TPL is 59.08% filled.)
